Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ShortGigs platform, operated by ShortGigs LLC, a Delaware limited liability company, with its registered office at 8 The Green, #20630, Dover, DE 19901 ("ShortGigs," "we," "us," or "our").

By creating an account, accessing shortgigs.ai, or using any ShortGigs service, you agree to be bound by these Terms. If you do not agree, do not use our platform.

You must be at least 18 years old to use ShortGigs. By agreeing to these Terms, you confirm that you meet this requirement.


1. The ShortGigs Marketplace

ShortGigs is an online marketplace that connects brands and businesses ("Buyers") with independent content creators ("Creators") for short-form content gigs, including but not limited to UGC videos, Instagram Reels, TikTok content, YouTube Shorts, and other social media deliverables.

ShortGigs is a platform intermediary. We are not a party to any contract between a Buyer and Creator. We do not employ Creators. Creators are independent contractors solely responsible for the services they provide.


2. Accounts

  • You must provide accurate, complete, and current information when creating your account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You may not share your account with others or create multiple accounts to circumvent platform rules.
  • You must notify us immediately at support@shortgigs.ai if you suspect unauthorized access to your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

3. Gigs, Applications, and Contracts

Buyers may post gigs describing a content deliverable they need. Creators may apply to gigs. A contract is formed when a Buyer accepts a Creator's application and completes payment through the platform.

Both parties agree to communicate in good faith, meet agreed-upon deadlines, and conduct themselves professionally. ShortGigs may remove gig listings that violate these Terms or our community standards at any time.

All agreements regarding scope, deliverables, revisions, and compensation are between the Buyer and Creator. ShortGigs is not liable for disputes arising from misunderstandings about gig scope.


4. Payments and Platform Fee

All payments on ShortGigs are processed through Stripe. When a Buyer pays for a gig, the funds are held through Stripe and are not released to the Creator until the deliverable is approved under the workflow in Section 5. After approval, the Creator's payout (the agreed gig price, net of any platform fee owed by the Buyer) is transferred to the Creator's connected account, and the bank payout then follows Stripe's standard schedule (typically 2–7 business days depending on country).

ShortGigs charges a 10% platform fee on the total gig value upon successful completion of a gig. This fee is charged to the Buyer's side of the transaction. No fee is charged if a gig does not close. Creators receive 100% of the agreed gig price, with no hidden deductions from the Creator's payout.

International payouts are facilitated through Stripe Connect. Creators receive payouts in their local currency. ShortGigs does not charge any additional markup on currency conversions, though standard Stripe or bank fees may apply depending on your country and payment method.

Payout timing depends on Stripe Connect's standard processing schedule, which varies by country (typically 2–7 business days after the payment is processed).

By using ShortGigs, you agree to the payment terms and authorize us (and Stripe) to charge and disburse funds on your behalf.


5. Payment Processing and Workflow

Payments are processed by Stripe. The platform-managed workflow is:

  1. The Buyer pays for the gig through the platform.
  2. The Creator submits the deliverable through the platform.
  3. The Buyer approves the deliverable, marking the contract complete.
  4. If a dispute is opened by either party, ShortGigs reviews the case and records an outcome.

If a Buyer does not respond to a submitted deliverable within a reasonable time, ShortGigs may at its discretion mark the contract complete after reviewing the submission. ShortGigs will notify both parties before taking such action.

Funds are held through Stripe after checkout and are released to the Creator only after the deliverable is approved (including the auto-acceptance case described above). ShortGigs does not hold funds in its own bank accounts; funds remain within the Stripe payment system until they are released.


6. Cancellations and Refunds

Refunds may be issued under the following conditions:

  • Before work begins: Full refund available if the Creator has not started the gig.
  • Creator non-delivery: If the Creator fails to deliver within the agreed timeline without communication, the Buyer may request a refund through our dispute process.
  • Deliverable quality: If the submitted deliverable materially fails to meet the agreed scope, the Buyer may raise a dispute. Partial refunds may be issued at ShortGigs' discretion following mediation.
  • After approval: Once a Buyer approves a deliverable and the contract is marked complete, refunds are not available except in cases of fraud.

7. Disputes

If a Buyer and Creator cannot resolve a disagreement, either party may escalate through the ShortGigs dispute system. ShortGigs will review submitted evidence from both parties and may facilitate mediation.

ShortGigs' dispute decisions are final on the platform. Any decision regarding payment outcome or refund is binding. ShortGigs does not provide legal arbitration services.

8. Intellectual Property

Upon full payment and Buyer approval of the deliverable, the Creator grants the Buyer a worldwide, non-exclusive, royalty-free license to use the delivered content for the purpose described in the gig, unless the parties have agreed in writing to different terms.

Creators represent and warrant that all content they deliver is original work, does not infringe any third-party rights, and they have the right to license such content to the Buyer.

ShortGigs retains all rights in its platform, brand, technology, and trademarks. You may not copy, modify, or reverse-engineer any part of the ShortGigs platform.


9. Prohibited Activities

You agree not to:

  • Use the platform for any illegal purpose or in violation of applicable law
  • Post, distribute, or solicit content involving minors in any inappropriate context
  • Circumvent the platform (e.g., by arranging off-platform payments to avoid fees)
  • Post false, misleading, or defamatory content
  • Spam, harass, threaten, or abuse other users
  • Upload malware, viruses, or harmful code
  • Attempt to gain unauthorized access to any part of the platform or another user's account
  • Violate any OFAC sanctions regulations or conduct transactions with sanctioned individuals or countries
  • Use automation scripts to scrape or bulk-access platform data without our consent

Violations may result in immediate account suspension and, where required by law, reporting to relevant authorities.


10. Reviews and Ratings

After a gig is completed, both Buyers and Creators may leave a review. Reviews must be honest, based on actual experience, and not defamatory. ShortGigs reserves the right to remove reviews that violate our content standards.

You may not solicit, incentivize, or coerce another user to leave a positive review, nor may you leave fake reviews for any purpose.


11. User-Generated Content

By posting content on ShortGigs (including gig descriptions, messages, portfolios, or deliverables), you grant ShortGigs a limited, non-exclusive, royalty-free license to display that content on the platform for operational purposes only. We do not sell or license your content to third parties.

You are solely responsible for the content you post. ShortGigs may remove any content that violates these Terms or applicable law, without notice.


12. Privacy

Your use of ShortGigs is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using ShortGigs, you consent to the data practices described in the Privacy Policy.


13. Disclaimer of Warranties

ShortGigs is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or free from harmful components.

ShortGigs does not guarantee the quality, accuracy, or legality of any content posted by users, or the ability of any Creator to deliver services.


14. Limitation of Liability

To the maximum extent permitted by law, ShortGigs LLC and its officers, directors, members, agents, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the platform or any gig transaction.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or your use of ShortGigs shall not exceed the greater of (a) the total fees paid by you to ShortGigs in the twelve (12) months preceding the claim, or (b) $100 USD.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so the above limitations may not apply to you to the full extent.


15. Indemnification

You agree to indemnify, defend, and hold harmless ShortGigs LLC and its members, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the platform; (b) your violation of these Terms; (c) content you post or deliver through the platform; or (d) your infringement of any third-party right.


16. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law principles.

Any dispute arising from or relating to these Terms or the ShortGigs platform shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) in Dover, Delaware, under its Commercial Arbitration Rules. The arbitration shall be conducted in English.

Class action waiver: You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any purported class or representative action.

EU/UK consumers: Nothing in this section limits your statutory rights as a consumer in the European Union or United Kingdom to bring claims before competent courts or regulatory authorities in your jurisdiction under applicable local law (including but not limited to the EU Consumer Rights Directive and the UK Consumer Rights Act 2015). Mandatory arbitration and class-action waivers do not apply to EU/UK consumers to the extent prohibited by applicable law.


17. DMCA and Copyright

ShortGigs respects intellectual property rights. If you believe that content on our platform infringes your copyright, please send a notice to our designated copyright agent at:

Your notice must include: (i) identification of the copyrighted work; (ii) identification of the infringing material with sufficient information to locate it; (iii) your contact information; (iv) a statement that you have a good-faith belief the use is not authorized; (v) a statement under penalty of perjury that the information is accurate; and (vi) your physical or electronic signature.


18. Modifications to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice on the platform or by email. Your continued use of ShortGigs after the effective date of any change constitutes your acceptance of the revised Terms.

We recommend reviewing these Terms periodically. The current version is always available at shortgigs.ai/terms.


19. Artificial Intelligence Features

Guardian advisory tools

ShortGigs offers Guardian — in-product advisory summaries and suggestions that help brands and creators understand fit, risk, and quality during the contract lifecycle. Guardian features include delivery review, payment assessment (pre-checkout advisory only), fit explanations, brief risk scan, revision guidance, dispute support summaries, and profile optimization suggestions. Guardian outputs are suggestions only; they do not hire creators, move money, approve deliveries, or resolve disputes.

Other AI-powered tools

ShortGigs also offers several additional AI features to help Buyers post gigs and discover Creators, and to help Creators improve their profiles. These include:

  • AI Campaign & Gig Assistant — generates structured gig drafts from your text brief
  • AI Team Assembly — generates multi-role project plans from your brief
  • AI Creator Coaching — analyzes your profile and metrics to provide improvement suggestions
  • AI Creator Matching & Semantic Search — ranks Creators and gigs by relevance using embedding similarity
  • Delivery quality scan — optional pre-submission quality feedback for creators
  • AI Brand Agent — monitors campaign health and suggests actions (when enabled)

Use of your content for AI processing

When you use Guardian or other AI features, relevant content you provide — such as campaign briefs, gig descriptions, profile information, delivery notes, or dispute context — is transmitted to our configured AI sub-processors for processing on the basis of our legitimate interests in operating the platform, as described in our Privacy Policy §12. Guardian routes to xAI (Grok) when our platform is configured with xAI API access, and otherwise falls back to OpenAI. Other AI features described above use OpenAI directly. You have the right to object to this processing at any time by contacting us at privacy@shortgigs.ai. We do not use your data to train AI models.

AI outputs are assistive, not determinative

AI- and Guardian-generated content (gig drafts, coaching reports, team plans, fit explanations, delivery summaries) is provided as a starting point for your own judgment. ShortGigs does not guarantee the accuracy, completeness, or fitness for purpose of any AI-generated output. You are responsible for reviewing and approving all AI-generated content before publishing or acting on it.

No significant automated decisions; payments stay with Stripe

No hiring, payment, dispute, or account-related decision is made solely by automated means. AI scores and Guardian recommendations are inputs to human decisions only. Card payments, escrow, and creator payouts are processed exclusively by Stripe — not by OpenAI, xAI, or any other AI provider.

AI feature rate limits

To maintain fair access and platform stability, AI features are subject to per-user rate limits (e.g., up to 10 AI gig generations or 5 coaching reports per hour). Attempts to circumvent these limits constitute a violation of these Terms.

AI disclosure label

Content generated or significantly influenced by AI is labeled as “Generated by AI” or “AI-assisted” where it appears on the platform, in compliance with applicable regulations including the EU AI Act Article 52 transparency requirements.


20. Termination

ShortGigs may suspend or terminate your account at any time for violation of these Terms, suspected fraud, illegal activity, or other conduct harmful to the platform or other users. You may terminate your account at any time through your account settings.

Upon termination, your right to use the platform ceases immediately. Sections 8, 13–16, and 19 survive termination.


21. Miscellaneous

  • Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and ShortGigs.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in full force.
  • Waiver: Our failure to enforce any right is not a waiver of that right.
  • Assignment: You may not assign your rights under these Terms. We may assign our rights in connection with a merger or acquisition.
